Threats to mediation
Whilst Mediation can be a cost-effective option for resolving disputes there are some situations in which it is unlikely to work – no matter what the skills of the Mediator.
In our view Mediation will probably NOT work when one or both parties think:
- I’m right and there is no room or time to hear anyone else’s views.
- I want to engage a solicitor at an early stage to protect my interests.
- Money is readily available to pay for emails, telephone calls, meetings etc.
- I want to make life difficult for those involved in a dispute with me.
- I feel that a Mediator will not be impartial or fair to me.
- I don’t have a problem, it’s the others.
- Time is not a problem. Happy for the dispute to drag on.
- My dispute involves domestic/sexual or child abuse.
