Mediation Guidelines

Our Mediation Guidelines


As a Mediator, I will:

  • Act impartially and independently at all times.
  • I will listen carefully and show respect for the views and opinions of both parties.
  • Not form any judgement about who is wrong or right in any disputed issues.
  • Attempt to reach a settlement which is acceptable to both parties.
  • Put in writing my decision and reasons for it and make this available to both parties in the event of any ongoing legal action.
  • Adjourn the mediation process if I feel a break is necessary to allow either party time to reflect.

Both parties to the mediation are expected to:

  • Respect the professionalism of the Mediator in helping to reach an acceptable settlement.
  • Sign an undertaking to either accept or reject the Mediator’s final decision.
  • Refrain from unproductive arguing, venting, or narration, and agree at all times to use mediation to work out a fair and constructive agreement.
  • Accept or reject the Mediator’s decision but this will then be recorded and may be disclosed to other persons in any ongoing legal action.
  • Agree to meet the Mediator individually and once together for the final decision and agreement.
  • Accept that third parties cannot be involved in the mediation process or meetings.
  • Inform the Mediator, with reasons, if they believe or feel that he is NOT acting impartially.
